1. Acceptance

By creating an account or using MENAContent AI, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Service

MENAContent AI provides AI-assisted marketing tools including content generation, visual generation, reels, campaign planning, scheduling, social publishing and optional paid-advertising workflows. Features may vary by plan and may change as the service evolves.

3. Accounts and security

You must be at least 18 years old and able to form a binding contract to use MENAContent AI. If you use it for a business, you confirm that you are authorized to act for that business. You are responsible for accurate account information, protecting your credentials, and activity performed through your account or connected social accounts.

4. User content and permissions

You retain rights to the content and business information you provide, subject to any third-party rights. You grant MENAContent AI the limited permission necessary to process, store, transform, publish or transmit that content only to provide features you request.

5. AI-generated content

AI output may contain errors, omissions or unsuitable suggestions. You are responsible for reviewing and approving content before publishing, advertising or relying on it. MENAContent AI does not guarantee legal compliance, factual accuracy, performance or business results from AI output.

6. Social-platform integrations

Use of Facebook, Instagram, Meta and other connected platforms is also subject to their own terms, policies and permissions. You must have authority to connect and manage any account, Page, asset or ad account you use with MENAContent AI.

7. Paid advertising

Paid Ads are optional. When enabled, MENAContent AI may prepare campaign structures, creatives, budgets or launch actions through supported advertising APIs. Ad spend is charged by the advertising platform to the payment method associated with your ad account, not as part of the MENAContent AI subscription unless explicitly stated. You are responsible for reviewing budgets, targeting, creatives and compliance before launch. Advertising performance is not guaranteed.

8. Plans, trials and payments

• Plans and prices are shown in the service at the time of purchase and are billed monthly by Stripe. Paid subscriptions renew automatically until cancelled.
• Credits. Each paid plan includes a monthly credit allowance. At the start of each billing period your balance is reset to your plan allowance; unused credits do not roll over and credits have no cash value. An upgrade during a period adds only the difference in allowance; plan changes are prorated by Stripe.
• Cost before creation. Paid creations show their credit cost before you approve them. Approved credits are reserved; if a creation fails before delivery, its reserved credits are returned. If an optional add-on such as lip sync fails, only that add-on’s credits are returned. Where a provider’s result cannot be confirmed, credits stay reserved until the result is reconciled.
• Free trial. New accounts may receive a 3-day trial with a one-time credit allowance. Some features, such as AI video and automatic replies, are not included in the trial.
• Cancellation. You can cancel renewal in your account at any time. Your plan stays active until the end of the paid period, and you can resume before then. Fees already paid are not refunded for partial periods, except where required by law.
• Payment processors may apply their own terms. Advertising spend is billed separately by the advertising platform (section 7).

9. Acceptable use

You may not use the service for unlawful, deceptive, infringing, abusive, malicious or unauthorized activity, or to violate platform rules, privacy rights, intellectual-property rights or applicable advertising laws.

10. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability. Hosting, AI, social and payment providers may experience outages or impose limits. We may modify, suspend or discontinue features where reasonably necessary.

11. Intellectual property

MENAContent AI, its software, branding, interface and original service materials are owned by or licensed to MENAContent AI. These Terms do not transfer ownership of the platform to users.

12. Termination

You may stop using the service at any time. We may restrict or terminate access for material violations, security risks, non-payment, fraud, abuse or legal requirements.

13. Disclaimer and limitation

The service is provided on an “as available” basis to the extent permitted by law. MENAContent AI is not responsible for indirect or consequential losses, third-party platform decisions, ad-account restrictions, rejected ads, or business results that depend on external services or user decisions.

14. Governing law

These Terms are intended to be governed by applicable laws of the United Arab Emirates, subject to mandatory consumer, privacy or other laws that may apply to you.

15. Changes

We may update these Terms as the service evolves. Continued use after an update constitutes acceptance of the revised Terms where permitted by law.

16. Likeness, identity verification and consent

Use only your own likeness, or another person’s likeness with their documented permission. Features that animate a real person may require identity verification (see the Privacy Policy). You must not use MENAContent AI to impersonate anyone, create deceptive or sexual depictions of real people, or bypass verification. We may suspend accounts that do.

17. Disclosing AI content

AI videos carry a metadata label, but platforms may remove it. You are responsible for disclosing AI-generated or AI-altered content wherever platform rules, advertising rules or the law require it.

بإنشاء حساب أو استخدام MENAContent AI فإنك توافق على شروط الخدمة هذه. إذا لم توافق عليها فلا تستخدم الخدمة.

2. الخدمة

تقدم MENAContent AI أدوات تسويق مدعومة بالذكاء الاصطناعي تشمل إنشاء المحتوى والتصاميم والريلز وتخطيط الحملات والجدولة والنشر الاجتماعي ومسارات الإعلانات المدفوعة الاختيارية. قد تختلف الميزات حسب الخطة وقد تتغير مع تطور الخدمة.

3. الحساب والأمان

يجب ألا يقل عمرك عن 18 عامًا وأن تكون أهلًا للتعاقد لاستخدام MENAContent AI. وإذا استخدمته لصالح نشاط تجاري فإنك تؤكد أنك مخوّل بالتصرف عنه. أنت مسؤول عن صحة بيانات الحساب وحماية بيانات الدخول وأي نشاط يتم من خلال حسابك أو الحسابات الاجتماعية المرتبطة.

4. محتوى المستخدم والصلاحيات

تحتفظ بحقوقك في المحتوى وبيانات النشاط التي تقدمها، مع مراعاة حقوق الغير. وتمنح MENAContent AI إذنًا محدودًا لمعالجة هذا المحتوى وتخزينه وتحويله أو نشره أو نقله فقط بالقدر اللازم لتقديم الميزات التي تطلبها.

5. المحتوى المنشأ بالذكاء الاصطناعي

قد يحتوي مخرج الذكاء الاصطناعي على أخطاء أو نقص أو اقتراحات غير مناسبة. أنت مسؤول عن مراجعة المحتوى واعتماده قبل النشر أو الإعلان أو الاعتماد عليه. لا تضمن MENAContent AI الامتثال القانوني أو الدقة الواقعية أو الأداء أو النتائج التجارية للمحتوى المُنشأ.

6. تكاملات منصات التواصل

يخضع استخدام Facebook وInstagram وMeta وغيرها أيضًا لشروط وسياسات وصلاحيات تلك المنصات. يجب أن تكون مخولًا لربط وإدارة أي حساب أو صفحة أو أصل أو حساب إعلاني تستخدمه مع MENAContent AI.

7. الإعلانات المدفوعة

الإعلانات المدفوعة اختيارية. عند تفعيلها قد تقوم MENAContent AI بإعداد هيكل الحملة أو الإبداعات أو الميزانيات أو أوامر التشغيل عبر واجهات الإعلانات المدعومة. يتم خصم الإنفاق الإعلاني بواسطة منصة الإعلانات من وسيلة الدفع المرتبطة بحسابك الإعلاني، وليس ضمن اشتراك MENAContent AI إلا إذا ذكر خلاف ذلك صراحة. أنت مسؤول عن مراجعة الميزانية والاستهداف والإبداعات والامتثال قبل التشغيل، ولا يوجد ضمان لأداء الإعلان.

8. الخطط والتجارب والمدفوعات

• الخطط والأسعار تظهر داخل الخدمة وقت الشراء وتُفوتر شهريًا عبر Stripe. تتجدد الاشتراكات المدفوعة تلقائيًا حتى تُلغى.
• النقاط. تتضمن كل خطة مدفوعة رصيد نقاط شهريًا. في بداية كل فترة فوترة يُعاد ضبط رصيدك إلى رصيد خطتك؛ لا تُرحَّل النقاط غير المستخدمة وليس لها قيمة نقدية. الترقية أثناء الفترة تضيف فرق الرصيد فقط، وتُحتسب تغييرات الخطة تناسبيًا عبر Stripe.
• التكلفة قبل الإنشاء. تعرض عمليات الإنشاء المدفوعة تكلفتها بالنقاط قبل موافقتك. تُحجز النقاط المعتمدة، وإذا فشل الإنشاء قبل التسليم تُعاد. وإذا فشلت إضافة اختيارية مثل مزامنة الشفاه تُعاد نقاط تلك الإضافة فقط. وعندما يتعذر تأكيد نتيجة المزود تبقى النقاط محجوزة حتى تتم المطابقة.
• التجربة المجانية. قد تحصل الحسابات الجديدة على تجربة لمدة 3 أيام برصيد نقاط لمرة واحدة. لا تشمل التجربة بعض الميزات مثل فيديو الذكاء الاصطناعي والردود التلقائية.
• الإلغاء. يمكنك إلغاء التجديد من حسابك في أي وقت. تبقى خطتك نشطة حتى نهاية الفترة المدفوعة، ويمكنك الاستئناف قبل ذلك. لا تُسترد الرسوم المدفوعة عن الفترات الجزئية إلا حيث يتطلب القانون ذلك.
• قد يطبق مزودو الدفع شروطهم الخاصة. يُفوتر الإنفاق الإعلاني منفصلًا من منصة الإعلانات (البند 7).

9. الاستخدام المقبول

لا يجوز استخدام الخدمة في نشاط غير قانوني أو مخادع أو منتهك للحقوق أو مسيء أو ضار أو غير مصرح به، أو بما يخالف قواعد المنصات أو حقوق الخصوصية أو الملكية الفكرية أو قوانين الإعلان المعمول بها.

10. التوفر والتغييرات

نسعى إلى تقديم خدمة موثوقة لكن لا نضمن عدم الانقطاع. قد تتعرض خدمات الاستضافة أو الذكاء الاصطناعي أو منصات التواصل أو الدفع لأعطال أو قيود. وقد نقوم بتعديل أو تعليق بعض الميزات عند الحاجة المعقولة.

11. الملكية الفكرية

MENAContent AI وبرمجياتها وعلامتها وواجهتها ومواد الخدمة الأصلية مملوكة أو مرخصة لها. لا تنقل هذه الشروط ملكية المنصة إلى المستخدم.

12. الإنهاء

يمكنك التوقف عن استخدام الخدمة في أي وقت. وقد نقيد أو ننهي الوصول عند وجود مخالفة جوهرية أو خطر أمني أو عدم دفع أو احتيال أو إساءة استخدام أو متطلبات قانونية.

13. إخلاء المسؤولية والحد منها

تُقدم الخدمة “حسب التوفر” إلى الحد الذي يسمح به القانون. لا تتحمل MENAContent AI المسؤولية عن الخسائر غير المباشرة أو التبعية، أو قرارات منصات الطرف الثالث، أو قيود الحسابات الإعلانية، أو رفض الإعلانات، أو النتائج التجارية التي تعتمد على خدمات خارجية أو قرارات المستخدم.

14. القانون الحاكم

تهدف هذه الشروط إلى الخضوع للقوانين المعمول بها في دولة الإمارات العربية المتحدة، مع مراعاة أي قوانين إلزامية لحماية المستهلك أو الخصوصية أو غيرها قد تنطبق عليك.

15. التغييرات

قد نقوم بتحديث هذه الشروط مع تطور الخدمة. استمرارك في الاستخدام بعد التحديث يعد قبولًا للشروط المعدلة حيث يسمح القانون.

16. الملامح والتحقق من الهوية والموافقة

استخدم ملامحك أنت فقط، أو ملامح شخص آخر بموافقته الموثقة. قد تتطلب الميزات التي تحرّك صورة شخص حقيقي تحققًا من الهوية (انظر سياسة الخصوصية). لا يجوز استخدام MENAContent AI لانتحال شخصية أي أحد أو إنشاء تصوير مضلل أو جنسي لأشخاص حقيقيين أو تجاوز التحقق، وقد نوقف الحسابات التي تفعل ذلك.

17. الإفصاح عن محتوى الذكاء الاصطناعي

تحمل فيديوهات الذكاء الاصطناعي وسمًا في بيانات الملف، لكن قد تحذفه المنصات. أنت مسؤول عن الإفصاح عن المحتوى المُنشأ أو المعدَّل بالذكاء الاصطناعي حيث تتطلب قواعد المنصات أو الإعلانات أو القانون ذلك.
